Communities
The Land Reform (Scotland) 2003 Act now permits communities to take control of their destinies. This can involve buying out land and housing or community assets and making them work for the community and not for private gain.
We can provide a full range of services for community buyouts including advice on:
- setting up organisations
- legal structures and governance
- charitable status; property acquisition
- leasing
- funding
- compliance and regulation
- procurement development
- renewable energy projects
- community contracts
TC Young advised registered Community Body, Bute Community Land Company (BCLC), in connection with their proposed buy out of Rhubodach forest on the Isle of Bute under the Land Reform legislation. Islanders on Bute voted to support the community plan to buy land owned by film director Lord Attenborough. The vote was, at the time, Scotland's biggest ever ballot on a community buyout proposal.
John McGhee, chairman of the BCLC said of the firm's involvement "The purchase of the Forest involved very long, drawn out and difficult negotiations for what was a very complex deal. I was extremely impressed with TC Young's commitment throughout this process. They were completely unflappable and the depth of their legal expertise showed through at every step of the way. On a personal level they were a delight to deal with but they combined this with rigorous analysis, clear advice and firm negotiations with the other parties involved."
The firm has also been involved in advising the Machrihanish Airbase Community Company(MACC), a registered community body, in connection with their proposed community buy out of the redundant 1,000 acre airfield. The ballot in which the residents in South Kintyre voted a massive ‘yes' for the opportunity to buy Machrihanish Airbase for £1 is the largest undertaken in Scotland so far.
We act for a significant number of community and regeneration organisations and are at the forefront of providing legal advice for various community bodies. These organisations have come to the firm because of our experience in this market and our pragmatic approach.
