The prospect of discussing personal matters with a solicitor can be daunting. At TC Young, our Family Law team are approachable and can be relied on to listen and provide sound and sensible advice. · Divorce/Separating couples: For both married and unmarried couples, agreement on financial issues can often be reached with the assistance of solicitors and then recorded in a written document, known as a Minute of Agreement (or separation agreement). We can also offer information about mediation and collaborative family law, which are increasingly used to resolve disputes without the need to go to court. When going to court is necessary, you can be assured that we have extensive experience handling divorce actions in the Scottish courts, many of which have involved complex financial issues such as pension rights, shares and taxation.
· Children: We act for both parents (and children) in situations where there are disputes concerning children, eg in relation to residence and contact. Our approach means, you will receive sound but sensitive advice.
· Cohabitation/Prenuptial Agreement: Legal advice may be required not only for separating couples but also for those forming relationships or entering into financial transactions with a partner. Prenuptial agreements are becoming more common, and the introduction in 2006 of new rules for cohabiting couples means it important to be aware at an early stage of your legal rights and consider a cohabitation agreement. We will talk you through the options available to allow you to make informed decisions about how to proceed to avoid disputes at a later stage.
