Christine Stuart has over 20 years’ conveyancing experience and leads the property team in Edinburgh, regularly advising on complex property, development and security matters for clients. She also has extensive experience dealing with all aspects of commercial leasing, ranging from the provision of shared accommodation in terms of simple licence agreements to dealing with full repairing and insuring leases of complex commercial subjects. Having represented both landlords and tenants in these transactions Christine has the insight to advise on practical solutions to issues which may arise reducing the time and money spent on pursuing unrealistic revisals. She is regularly involved in both land acquisitions and property disposals and negotiates Development Agreements for clients with both local authorities and private developers, managing questions of risk, timing, payments and quality.
She has a keen interest in assisting clients with managing housing stock and regularly supplies advice on the interpretation and drafting of factoring agreements, deeds of conditions and utilisation of statutory provisions to ensure works can be carried out and charged to owners and occupiers.
Having previously led a charity team within another firm Christine continues to provide guidance to charities and voluntary organisations. She was recently involved in a transaction for a Trust, where as lead partner she was involved the reorganisation of this charity. By working alongside the client, regular communication and extensive research, the tight deadline for the transaction was met. Part of the reorganisation involved the transfer of all property (including hundreds of homes, commercial units, agricultural land, residential care homes and sheltered housing flats) from one body to a newly constituted charity. This involved the firm working with our clients to find solutions which resolved the issues but did not involve the residents on site, many of whom are elderly or frail, so as not to put them under any undue stress. At the initial acquisition stage we also undertook a significant role in negotiation and settlement of the funding requirements of £23million and obtaining the approval of OSCR on all of the charitable aspects of the project.
Christine adopts a pro-active approach to supporting clients in an ever-changing sector and regularly provides briefings, training sessions and participates in conferences, speaking on a range of charity and property related topics.
