Jim has specialised in tenancy related matters since 1994 and has over 20 years experience in Sheriff Court work throughout Scotland. He is a key member of the housing management team using his experience to give clients clear and uncomplicated advice on complex and awkward issues arising from topics such as recovery of possession, succession to tenancies, repairs, leases, right to buy and anti social behaviour.
Jim has represented clients in numerous cases which are now regarded as legal precedents in housing management law. This includes decisions on: Eviction for rent arrears and antisocial behaviour (including general disorder and criminal activities including drug dealing). He has also had notable success in dealing with wrongful claims to successions to tenancies. Jim has also been involved in numerous cases which relate to repairs duties, notices to quit, Right to Buy and many other aspects of court procedures relating to housing cases
He is a visiting lecturer at Heriot Watt University and a prolific contributor to seminars and conferences across Scotland, covering the whole range of housing management issues (civil work and tenancy and lease related matters). Jim’s work with the Chartered Institute of Housing (CIH), Scottish Federation of Housing Associations (SFHA), Legal Services Agency (LSA) and various local authorities, displays a robust understanding of current issues. Recognised as an expert in this field, he has contributed articles to various journals and has written a number of information leaflets on different aspects of Housing Law published by LSA. He is also co-author of the CIH publication on “Suspending Housing Applicants - a Practical Guide”.
His expertise has been externally acknowledged by his appointment as a legal member of the Private Rented Housing Panel for Scotland.
Jim also takes a keen interest in health & safety matters. He is involved in any actions against clients under health and safety legislation including charges of negligence raised in relation to accusations of health and safety failings and compensation claims raised by staff, third parties or a contractor.
