Rise in Court Fees
From 1 August 2008 the fees charged by the Sheriff Courts will increase. This increase has been proposed in order to reduce the current level of public subsidy for the Scottish Court Services, and to try and distribute the subsidy more fairly between the Court of Session, Sheriff Courts and Office of the Public Guardian.
In particular, landlords should be aware that the cost of raising both a Summary Cause and Small Claim action will increase from the current fee of £44 to £60. Therefore all actions which are raised from 1 August 2008 onwards for recovery of possession of property and/or payment up to a maximum of £5,000, will be subject to court warranting dues of £60.
Further, the court fee for the warranting of a Summary Application, which includes an application for an Antisocial Behaviour Order, will rise from £57 to £75.
Some of the main fee changes from 1 August 2008 are listed below:
Summary Application: £75 (currently £57)
Summary Cause Summons: £60 (currently £44)
Small Claim Summons: £60 (currently £44)
Petition for sequestration of estates: £90 (currently £71)
Lodging a Written Motion: £35 (currently £29)
