TC Young’s charity law team, is led by Mark Ewing; one of only 10 Solicitors in Scotland recognised by the Law Society of Scotland as specialists in charity law.

With over 30 years of legal experience Mark has grown the firm’s business in the charity and voluntary sector, both in terms of work with existing charities and new charity registrations.   The firm currently advises more than 200 charities, ranging from small community organisations to large national ventures.   During this time the team has also developed a strong working relationship with the Office of the Scottish Charity Regulator.

The firm has been particularly proactive recently advising charities on matters driven by the current economic down turn. This has included advising charities on a number of initiatives including mergers and joint working to reduce overheads, and has taken forward a number of charity re-organisation schemes.

For organisations aspiring to charitable status, they must ensure that their aims and objectives meet the new charity and public benefit test as administered by the Office of the Scottish Charity Regulator OSCR.

Our extensive experience in this area means we can offer considerable assistance to charitable organisations:
·         helping them to quickly comply with existing and forthcoming legislation
·         who wish to set up subsidiaries
·         looking to purchase land and advice on how to use it
·         with queries regarding trading

With the majority of Scottish housing associations now having charitable status, charity law is of considerable and increasing importance. We have been at the forefront of discussing issues with the charity regulator and this relationship will be of increasing significance as housing associations begin to come forward for rolling review by the charity regulator.

The firm is also heavily involved in training initiatives and conferences in the field of charity law and governance.
