Family Law

The breakdown of a relationship is a distressing and emotional time, when the prospect of discussing personal matters with a solicitor can be daunting. Our aim is always to offer support and make you feel comfortable so that you can ask all of the questions that will be on your mind. At TC Young you can speak in confidence to us. We will not only clearly explain your rights but will listen to you and understand your needs.

 

We can offer assistance on a wide range of family law issues and will discuss at the outset what the best way to proceed is for you. For separating couples, both married and unmarried, agreement on financial issues can often be reached with the assistance of solicitors and then recorded in a written document, known as a Minute of Agreement. We can also offer information about mediation and collaborative family law, which are increasingly used to resolve disputes without the need to go to court. When going to court is necessary, you can be assured that we have extensive experience of handling divorce actions in the courts, many of which have involved complex financial issues such as pension rights, shares and taxation.

 

In situations where there are disputes concerning children, for example in relation to residence and contact, you will be able to rely on receiving not only sound but sensitive advice. We act for both parents and children. Our principal family solicitor is regularly appointed by various courts to act as curator ad litem (to protect the interests of children affected by litigation) and to act as a Reporter for the Court in disputed cases involving the welfare of children; to investigate and make a recommendation to the sheriff as to the best interests of the child or children concerned.

 

Legal advice may be required not only for separating couples but also for those who are forming relationships or entering into financial transactions with a partner. Pre- nuptial agreements are becoming more common, and the introduction in 2006 of new rules for cohabiting couples means that it is very important to be aware at an early stage of the legal position and to consider a cohabitation agreement. We will talk you through the options available to allow you to make informed decisions about how to proceed to avoid disputes at a later stage.

 

We are registered by the Legal Aid Board to provide legal aid and legal advice and assistance through the Scottish Legal Aid Scheme.
