Housing Management
Housing management advice is a significant part of our daily work. We provide a comprehensive legal service on all aspects of housing management in Scotland and are acknowledged by the profession as the most knowledgeable practice on Scottish Tenancy law.
On a daily basis we deal with clients’ specific questions on a wide range of housing management matters such as:
- Recovery of Possession
- Rights to succession
- Entitlement to the right to buy
- Allocations and nominations
- Rent arrears
- Anti Social Behaviour
- Gas Servicing
- Policy and Procedure reviews
- Factoring
- General maintenance issues
- Shared ownership
The firm is a leader in the sector in the area of advising landlords on how to tackle anti social behaviour in line with the requirements set out in the Anti-Social Behaviour (Scotland) Act 2004, the Homelessness (Scotland) Act 2003 and of course the Housing (Scotland) Act 2001.
Our advice and support includes:
- Training on a wide range of topics associated with anti-social behaviour
- Advising clients on the procedures involved in raising ASBOs.
- Raising interim and full ASBOs.
- Guiding clients on implementing actions post the passing of an ASBO.
- Representing clients in court.
We raise recovery of possession actions and have extensive practical court experience in dealing with a broad range of these actions covering the whole spectrum of breaches. We also defend actions and action appeals in the Sheriff Courts and the Court of Session on a wide variety of housing matters. We provide debt recovery services for our clients for factoring arrears, rechargeable repairs and all other debts. We are involved in ongoing actions for breaches of various LSVT contracts against the Scottish Ministers, formerly Scottish Homes.
In addition to providing very practical advice in these areas, we regularly provide wider support in the form of in-house training.
Recently we have provided training for four Local Authorities on aspects of anti-social behaviour, another Local Authority on the Short Scottish Secure Tenancy, we provide tutoring services to Heriot Watt University on the legal aspects of housing management and we have been commissioned by a large national charity to provide training on all aspects of housing law. As recognised leaders in the field of housing management we are regularly involved in training for not only RSLs but for other lawyers.
Working with a wide range of registered social landlords and the SFHA we are frequently consulted for advice and comments on new legislation and housing policy affecting RSLs. With strong links to Communities Scotland we are frequently asked to comment on policy developments. We have also advised clients on making submissions to the Scottish Parliament when new legislation is proposed and have supported clients in their presentation to the committees of the Scottish Parliament.
