Sessions
30/09/2025: ASB – support, remedies and challenges
Anti-Social Behaviour (ASB) can be difficult for housing staff. This session will focus on how to bring a Scottish Secure Tenancy (SST) to an end by reason of ASB. We will look at the use of Anti-social Behaviour Orders (ASBOs) as well as discussing how you may convert a SST to a Short Scottish Secure Tenancy (SSST); detailing how you can bring a SSST to an end if ASB continues. We will touch upon the court processes involved along the way, plus look at the advantages and disadvantages of each option.
02/10/2025: Streamlined Evictions – case updates
There has been a flurry of case reports providing interesting commentary from Sheriffs on repossession actions based on Ground 2 (criminal convictions) in terms of the “streamlined” eviction procedure. We will focus on those decisions and provide you with useful takeaways to assist you in progressing cases of this nature to a successful conclusion. We will also look at the potential lines of defence available to tenants.
07/10/2025: Deceased Tenants & Abandonments
Abandonments are straightforward, aren’t they? Not always. The first half of this session will look at repossessing abandoned tenancies: the procedure, what inquiries to make and the challenges you could face.
The second half will focus on succession issues. This will include what to do when a tenant passes away, who to speak to, who to take instruction from, the rules of succession and when you might consider applying “exceptional circumstances” to those rules.
09/10/2025: Condition of Property Cases – what to do and when
Tenancy enforcement measures on the basis of unacceptable condition of/damage to the tenancy or non-occupancy of the tenancy are on the increase. This session will look at pre-court steps that should be considered, the need for early intervention, and options available in relation to tenancy enforcement, including evidence required and prospects of success.
21/10/2025: Rent Arrears – PARs compliance and challenges
There is an increased scrutiny of PARs in rent arrears cases. The Notice of Proceedings (NOPs) is also subject to scrutiny. This session will focus on those challenges, and how to avoid dealing with challenges in any court proceedings that may be raised after PARs have been completed and NOP service has taken place.
23/10/2025: Proofs – what to expect when giving evidence
Following on from the Sheriffs Principal Guidance Note on the handling of heritable repossession cases for RSL tenancies issued in July 2022, we continue to see an increase in cases being progressed to full evidential (Proof) hearings. Why is this? This session will focus on the court procedure, the steps involved, the powers of the presiding Sheriff, as well as looking at how an evidential hearing is run and steps to take if you are asked to appear as a witness in an evidential hearing.

Alastair McKendrick, head of our litigation team, is an accredited specialist in Housing and Residential Tenancy Law. He has extensive experience in housing matters and manages a wide variety of cases including construction, contract and property disputes for RSLs, letting agents and private landlords.
