The UNCRC (Incorporation) (Scotland) Act 2024 came into force on 16 July 2024 and makes children’s rights directly enforceable in Scots law. Public authorities are prohibited from acting incompatibly with UNCRC rights.
Registered Social Landlords (RSLs) are likely to be caught by the Act when they are carrying out functions of a public nature, such as managing social housing and pursuing evictions. Evictions involving households with children are a children’s rights issue, not just a housing management issue. Section 6 of the Act makes it unlawful for a public authority to act in a way that is incompatible with UNCRC requirements. For evictions, this encapsulates:
• The decision to evict
• The process followed
• The consideration of alternatives
Children (or their representatives) can challenge unlawful decisions in court, and courts can grant remedies.
