Alastair McKendrick

Alastair McKendrick is a litigator with 10 years’ experience of court work. He also leads the team advising clients on data protection matters and GDPR compliance. He was promoted to Partner in 2018 and manages a wide variety of cases including construction, contract and property disputes, together with all aspects of housing law for Registered Social Landlords (RSLs), letting agents and private landlords.

Data Protection issues – Alastair advises clients in relation to a variety of data protection issues, including the review of policies and procedures and contentious matters, including breaches. He guides clients on the impact of the new General Data Protection Regulation which came into force in May 2018 and leads training sessions on this topic.

Litigation – He handles all litigation matters, which includes pursuing and defending civil litigation, and actions for damages (including claims for compensation raised against clients). Alastair appears in Sheriff Courts throughout Scotland handling a range of disputes, including actions of payment, damages and interdict.

Involved in arbitration and adjudication proceedings for clients, he successfully acted for an client in a mediation concerning a long-running construction dispute with the client’s design team and contractor. Terms of settlement were agreed without the client having to pursue a lengthy and costly litigation.

Alastair has conducted a vast array of cases for housing providers handling a range of both housing management and non-housing management disputes for these providers, to include debt recovery actions, construction and contractual disputes, rent arrears and anti-social behaviour eviction actions.

Court of Session – He handles all types of Court of Session actions and as a result liaises with Counsel regularly. These actions include both commercial and ordinary actions, judicial review proceedings and appeals.  As part of his Court of Session caseload, he is regularly instructed as Edinburgh agent on behalf of firms across Scotland and as a result handles a wide variety of cases in that capacity.

Factors – He advises RSL factors and other factoring organisation on all contentious matters.  He has represented factors in both the Sheriff Court and at hearings before the First-tier Tribunal (formerly the Home Owner Housing Panel).
