Working across our Edinburgh and Glasgow offices, employment Associate Marianne McJannett assists clients on a daily basis in managing difficult HR issues within their organisations as well as advising individuals of their employment rights during difficult periods of their employment. She jointly leads the delivery of employment law advice within TC Young.
She provides practical advice on necessary employment procedures and has experience in drafting contracts of employment, service agreements and policies for organisations. Marianne advises organisations on performance management, redundancy and re-organisation matters and has experience in drafting settlement agreements on behalf of companies following these discussions if appropriate. She also has experience in advising individuals on the implications of settlement agreements.
Marianne has a thorough understanding of the Equality Act 2010 and provides advice to clients on their obligations under the 2010 Act, ensuring that they have Equal Opportunity Policies in place. She also advises clients on Data Protection issues including subject access requests and employer obligations in relation to storage of employee information.
She is able to provide support and advice surrounding TUPE, both in relation to mergers as well as service provision changes, and has experience in assisting organisations, both pre and post transfer, with their obligations under these Regulations.
Marianne represents clients at employment tribunals on behalf of individuals and employers. She is involved in the preparation of and attendance at tribunals on a number of subjects including: unfair dismissal, maternity discrimination, Working Time Regulations, disability discrimination and sex discrimination. She is a strong negotiator and has settled a number of contentious issues before they have reached a tribunal hearing.
